What is Divorce Mediation? Know The Basics!

During a divorce, both spouses should sit together and discuss things, so the divorce runs smoothly. Divorce mediation can help both parties put their grounds for divorce and help them get what they want.

Divorce mediation can only happen when both parties are willing to listen to each other’s terms and conditions. It happens with a mediator being the joint negotiator between the spouses.  If you are seeking a divorce, you should immediately contact Turco Legal to know all the possibilities and how you can make your divorce less complicated and quicker.

What is divorce mediation?

In the case of divorce mediation, both partners meet each other with a common mediator being present. The mediator helps discuss and resolve issues in your divorce to avoid going to court.

Important decisions like child custody, child support, alimony, and property distribution can be made in the presence of a mediator so that they can help both parties agree on familiar grounds.

However, a mediator does not make decisions on behalf of the couple or offer legal advice; they serve as negotiators and help the partners determine the best solution for both.

Once the negotiation is over and the partners agree to each other terms and conditions, the mediator will make a divorce settlement agreement.

Why choose a divorce mediator?

The judge usually orders the couple to go through the mediation process. You can do it independently if the judge does not recommend it. Depending on you, you can appoint a mediator before filing for a divorce or anytime during your divorce process.

Mediating your divorce will always be beneficial to you in a lot of ways. Some of them are:

  • Expenditure– Mediating will cost you much less than a court trial
  • Fair settlement- In most mediation sessions, both parties make a fair settlement at the end.
  • Confidentiality– Having a divorce mediator ensures your privacy, and the mediation does not have a public record of the case. Everything discusses in a mediation is confidential.
  • Freedom of decisions– In mediation, both parties get the freedom to decide their conditions, negotiate and then agree to whatever they want. This is more beneficial than the court deciding the post-divorce terms for you.
  • Seeking help is allowed– A mediation allows you to seek advice from your lawyer even when you have agreed to the session.
  • Control– Whole control of the terms and conditions is in your and your partner’s hands.
  • Healthy communication- having a mediator encourages positive communication between you and your spouse, resulting in lesser future conflicts.
